Lost Baggage

General Principles

  • Checked baggage is deemed to be lost for the purpose of compensation if:
    • the airline admits the loss, or
    • it has been missing for more than 21 days.
  • The airline is liable for damages caused by loss of checked baggage, up to a certain limit:
    • CAD$1,500 - CAD2,100 on domestic itineraries within Canada (depending on the airline);
    • CAD$2,100 (approx.) on international itineraries; and
    • US$3,500 on domestic itineraries within the US.

Applicable Law

Your rights are governed by:

  • the airline’s Domestic Tariff, if you were travelling only within Canada,
  • the Montreal Convention, if you were travelling on an international itinerary, and
  • 14 CFR Part 254.4, if you were travelling only within the United States.
