Lost Baggage

General Principle

Checked baggage is deemed to be lost for the purpose of compensation if:

  • the airline admits the loss, or
  • it has been missing for more than 21 days.

The airline is liable for damages caused by loss of checked baggage, up to a certain limit.

Applicable Law

Your rights are governed by:

  • the Montreal Convention, if you were travelling on an international itinerary,
  • the airline’s Domestic Tariff, if you were travelling only within Canada, and
  • 14 CFR Part 254.4, if you were travelling only within the United States.
